Cruz Proposes Constitutional Amendment…

Article V of the United States Constitution states, “The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate.”

Republican/Tea Party (GOTP) Presidential hopeful Ted Cruz has said he will propose a Constitutional amendment where the country will hold judicial retention elections every eight years for Supreme Court justices saying, “When they (the Supreme Court) violate the constitutional amendment and the law, the American people can remove them. We are not governed by a judicial priesthood. We are not governed by judicial tyranny.”

There are a few obstacles to Cruz’s dream of upending the Supreme Court.

First, in order to get an amendment through the Congress he would have to garner 2/3 of both houses, that would be 357 members of the House and 67 members of the Senate, meaning he would have to get 112 Democratic members of the House to go along with him – that is flat out never going to happen –  and additional to that he would need 13 Democrat Senators to vote with him, also never going to happen. He would – if he could get it to pass Congress – need 38 State Legislatures to ratify it, meaning at least seven legislatures not controlled by Republicans would have to ratify – yeah right.

Let us suppose he goes the State Conventions route. He would need 34 states out of the 50 to vote for the amendment, meaning at least three states not under GOTP control would have to go along with the Snake Oil Salesman from Canada.

Cruz is posturing, just posturing – either that or he is certifiable.

Latest 2016 Presidential Polls – 8 June 2015 Edition

Slog, slog, slog – The 2016 Presidential Election season slogs along – the Republican Tea Party (GOTP) clown car continues to pick up occupants – at some point one would think it will reach critical mass – while the Democratic Party drags along, picking up few contenders.

Where are things in the waning days as we move into the first summer of 2016 campaign season?

Nationally, a Fox News poll, conducted by telephone of “registered voters” from May 31 – June 2, 2015, has a two-way tie in the GOTP with Jeb Bush and Scott Walker at 12% each; Ben Carson 11%; Rand Paul 9%; Ted Cruz 8%; Marco Rubio 7%; Mike Huckabee 6%; Chris Christie 5%; Donald Trump and Rick Perry 4%; and last of all there is a four-way tie for tail-end Charlie, John Kasich, Carly Fiorina, Rick Santorum and Lindsey Graham at 2%

On the Democratic side, the same poll has Hillary Clinton still way out in front with 57%, followed by Bernie Sanders at 11%, Vice-President Joe Biden 8%, Martin O’Malley 4%, Jim Webb 2%, and Lincoln Chafee at 1%.

According to a CNN/Opinion Research Poll, conducted 29-31 May, if the General Election was today:

Clinton 52/Cruz 43

Clinton 51/Bush 43

Clinton 49/Walker 46

Clinton 49/Rubio 46

Clinton 48/Paul 47

The poll did not ask voters about a match-up between Clinton and Carson, Huckabee, Christie, Trump, Perry, Kasich, Fiorina, Santorum or Graham.

According to recent polling data available, if the election was today Hillary Clinton would be the 45th President of the United States, and the others would be footnotes in history books.

Paul’s desire to end NSA data collection is something I can agree with 100%, but he doesn’t need to lie about where the program came from to get the job done. That’s being political, and it cheapens what he is trying to achieve.

Nationally, a Quinnipiac poll, conducted by telephone of “registered voters” from 19-26 May 2015, has a five-way tie amongst the GOTP with Jeb Bush, Scott Walker, Marco Rubio, Mike Huckabee and – of all possible people – Ben Carson at 10% each. Completing the current pack, Rand Paul has 7%; Ted Cruz 6%; Donald Trump 5%; Chris Christie 4%; John Kasich and Carly Fiorina are tied at 2%; Rick Perry and Bobby Jindal each have 1% and just announced candidate Rick Santorum registers with 0%.

On the Democratic side, the same poll has Hillary Clinton still way out in front with 57%, followed by Bernie Sanders at 15%, Vice-President Joe Biden 9%, and Jim Webb, Martin O’Malley and Lincoln Chafee at 1% respectively.
